Doesnt matter. If rape is legal, woman can trick her rapist or pay someone else to tie him down (people who hate rapists will do it for free), and then she can rape her rapist and get as much payback as she wants.

I'd probably move 5 and 11 to rape category. 5 it kind of depends because if you know the other person wouldn't mind, than not revealing it isn't really rape by deception. But otherwise that's a pretty significant thing not to reveal.
And yeah rape by deception is a hard line to draw because you can lie about some things and it's not rape, but I think AFAB/AMAB is a big enough thing it would count. But a cis woman implying they are a cis man or vice versa before doing sexual acts crosses the line imo, and I think a trans man/woman implying they are cis or vice versa also crosses it.
But you should ask every time, just as you would for anything that's a deal breaker to you.

Legalizing rape would render the act as permissible non-consensual sexual molestation and/or penetration.

What if nobody wants to rape the rapist?
There is always someone who wants to rape the rapist. Rapists get raped a lot in prison, and there are even private organizations hunting them. Now imagine what those private organizations would do if rape was legal. The only way rapist wouldnt get raped is if his victim chooses to tell no one, but in that case, any system would be powerless.

Every crime has a spectrum of some kind, that’s why we have judges and in some jurisdictions juries who decide on sentences.
Stealing a candy bar is not the same thing as robbing a bank, so theft has a spectrum.
Killing someone is manslaughter, killing someone’s with malice or forethought is murder, so even unaliving others has a spectrum.
The existence of a spectrum doesn’t make any action better or worse.

If someone robs a candy bar, then they won't get punished, so it's basically legal (illegal but unenforced is de facto legal).
Now you're just pretending that you didn't make the argument you did before.
Stealing a candy bar is not legal, we just don't treat it as seriously as we do other forms of theft because it's not as serious, despite the fact that they both exist on the spectrum of theft.
What forms of rape would you convict people for?
I would have a spectrum of charges to convict for to match the spectrum of seriousness of possible rape crimes.
